High Court Rejects 16 Documents Submitted by Assam Man, Upholds Foreigner Tribunal's Citizenship Ruling

The Gauhati High Court has upheld a Foreigners Tribunal's decision declaring an Assam resident a foreigner, ruling that the 16 documents submitted by him were not sufficient to establish his claim to Indian citizenship. The petitioner had challenged a 2019 order of the Foreigners Tribunal, arguing that he had produced multiple official records to prove his citizenship. These documents reportedly included entries from the 1951 National Register of Citizens (NRC), electoral rolls, land records, educational certificates, a PAN card, and voter identity documents.

After examining the case, the High Court found that the documents did not create a credible and continuous link between the petitioner and his claimed Indian ancestors. The bench observed that while several records had been produced, they failed to satisfy the legal requirements needed to prove citizenship.

The court reiterated that under Section 9 of the Foreigners Act, the burden of proving citizenship lies with the person whose nationality is under question. It noted that the authenticity and consistency of documents are more important than their number. According to the judgment, the Foreigners Tribunal had carefully assessed the evidence before concluding that the petitioner had failed to discharge the legal burden placed upon him. The High Court said it found no reason to interfere with the tribunal's findings, as there was no apparent legal or procedural error in the earlier decision.

The ruling reinforces a well-established legal principle in citizenship cases, particularly those arising in Assam, where courts require clear, reliable, and consistent documentary evidence to establish citizenship. Documents containing discrepancies or failing to demonstrate a continuous family linkage may not be sufficient, even if they are issued by government authorities.

Citizenship-related cases remain a sensitive issue in Assam, where Foreigners Tribunals examine disputed nationality claims under the Foreigners Act. The latest judgment is expected to serve as another significant reference in similar cases, highlighting that the quality and credibility of evidence take precedence over the quantity of documents submitted.
