Supreme Court Supports Unified Hearing for Mathura Land Cases

The Supreme Court, on Friday, expressed its reluctance to interfere with a judicial order consolidating several lawsuits related to the Sri Krishna Janmabhoomi-Shahi Eidgah Masjid land dispute in Mathura. The court observed that such consolidation benefits both parties by ensuring a streamlined process and minimizing the risk of contradictory judgments. A bench comprising Chief Justice of India (CJI) Sanjiv Khanna and Justice PV Sanjay Kumar noted that grouping the cases allows for centralized and efficient adjudication.
The bench further emphasized that the broader question concerning the validity of these suits, in light of the Places of Worship (Special Provisions) Act, 1991, is already pending before the apex court. It stated that challenging every procedural decision unnecessarily delays the resolution of the core issue. "Why should we interfere with the order of consolidation in the high court? We are examining the larger issue. How does it make a difference? It’s better if all similar suits are taken together. Everything is not to be contested," the bench remarked.
Tasneem Ahamadi, the advocate representing the mosque management committee, argued that the consolidation of cases could materially affect the proceedings and requested an adjournment. However, the bench maintained its stance, stating that multiple proceedings would complicate matters for both parties. “It’s better for you and the other side too. Let it be. If required, we will adjourn it, but in our opinion, this doesn’t need to be contested,” it asserted.
The court decided to adjourn the matter for further hearing in April 2025, allowing time for both parties to prepare for the consolidated cases while reaffirming its position on streamlining the legal process.
