BMW crash case: Accused Gaganpreet claims the collision was accidental and unintentional; mother of two requests bail.

In the BMW accident near Dhaula Kuan that resulted in the death of Ministry of Finance Deputy Secretary Navjot Singh, accused Gaganpreet Kaur has applied for bail, asserting that the crash was “entirely accidental” and unintentional. Her lawyer emphasized that Kaur, a mother of two young daughters, has no prior criminal record and sustained a head injury in the accident herself.
The bail application, filed under Section 480 of the Bharatiya Nagarik Suraksha Sanhita, 2023, argued that custodial interrogation is unnecessary. It further stated that Kaur has cooperated fully with the investigation, has strong social ties, and there is no risk of her absconding or tampering with evidence.
On Monday, Duty Judicial Magistrate Akanksha Singh sent Kaur to two days’ judicial custody after she was presented by Delhi Police. The court issued notice on her bail plea, scheduled the hearing for September 17, and directed jail authorities to ensure she receives proper medical care. Senior Advocate Vikas Pahwa, along with Advocate Prabhav Ralli representing Kaur, opposed the police’s remand request, citing a 10-hour delay in filing the FIR. Advocate Ishan Dewan represented the victims.
Police have invoked sections related to culpable homicide not amounting to murder, among others. According to the prosecution, Kaur’s BMW hit a divider and flipped, causing the victim’s motorcycle to collide with a DTC bus. Kaur, her family members, and the motorcyclists were injured and hospitalized before her arrest on September 15. She will remain in judicial custody until her bail hearing on September 17.
